We welcome you to PrimeTime Shots, Inc. By clicking the “agree” button during the checkout process, you do hereby agree to the Terms and Conditions of Use posted on this agreement. This constitutes a legal and binding agreement between you (and your employer if using this site on your employer’s behalf) and PrimeTime Shots, Inc. PrimeTime Shots, Inc. reserves the right to modify this agreement when necessary and without prior notice, and will post updated changes on it’s site. The Terms and Conditions of Use are binding according to the terms and conditions given at the time you are using this site.
PrimeTime Shots, Inc. is privately owned and operated. Every aspect of the PrimeTime Shots, Inc. website including its images, text, graphics, illustrations, and trademarks (and those things related but not listed) is owned by PrimeTime Shots, Inc. and/or its affiliates and is protected by U.S. and International copyright laws.
Any rights not individually listed in this agreement are retained by PrimeTime Shots, Inc. PrimeTime Shots, Inc. has the right to discontinue use of this site and its product licenses to anyone who fails to abide by the Terms and Conditions of this agreement agreed to upon checkout. Following such action the terminated party will agree to discontinue using the site and delete or return all images and discs to PrimeTime Shots, Inc. upon request.
PrimeTime Shots, Inc. makes an effort to provide accurate, reliable information on its site. However, PrimeTime Shots, Inc. does not guarantee that its site will be error free. There is no warranty (unless otherwise specifically stated), expressed or implied, regarding any information, any images, or any use of this site. This includes any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose, or that the site will be free from interruptions. You assume all risk, including any necessary servicing or repair due to your use of this site.
In no way shall PrimeTime Shots, Inc. or it’s representatives or affiliates be responsible to you or any third party for damages of any kind (including but not limited to direct indirect, lost profits, incidental, compensatory, or special damages) stemming from your specific use of this site or it’s content, with the exception of any liability which can not be excluded by law. Under no circumstances shall PrimeTime Shots, Inc. or its affiliates’ liability ever exceed the amount paid by you to license the image in question.
In the event that a dispute arises between PrimeTime Shots, Inc. and you, any and all attorney and legal fees will be recovered from you by PrimeTime Shots, Inc. Disputes arising from this agreement will be interpreted and governed by the laws of the State of Pennsylvania, USA. All parties will agree to exclude the governing jurisdiction by the United Nations Convention on Contracts for the International Sale of Goods. Any and all notices and documents resulting from a dispute over this agreement shall be written in the English language.
There exists no action of PrimeTime Shots, Inc. that may be interpreted as a waiver for any of the Terms and Conditions of Use listed in this agreement, except an express written waiver. If any part of this agreement is found unenforceable all other aspects of the agreement will remain in force. |
